Abortion measures on the ballot

On Tuesday, ten states – one-fifth of the country – had ballot measures to add state constitutional protections for abortion "rights." In a majority of the cases, the pro-abortion measure passed.

STATE DESCRIPTION STATUS
Arizona The "Right to Abortion Initiative" (Prop. 139) would amend the state constitution to provide for the "fundamental right to abortion" in Arizona.

Colorado The "Right to Abortion & Health Insurance Coverage Initiative" (Amendment 79) would create a right to abortion in the state constitution and allow the use of public funds for abortion.

Florida The "Right to Abortion Initiative" (Amendment 4) would add the following language to the Florida Constitution's Declaration of Rights: "… no law shall prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect the patient’s health, as determined by the patient’s healthcare provider." It would leave in place the parental notification requirement.

Maryland The "Right to Reproductive Freedom Amendment" (Question 1) would establish a "right to reproductive freedom" [abortion] in the Maryland Constitution's Declaration of Rights.

Missouri The "Right to Reproductive Freedom Amendment" (Amendment 3) would create a "fundamental right to reproductive freedom" [abortion] and "all matters relating to reproductive health care" in the Missouri Constitution. The measure would also overturn Missouri Senate Bill 49, passed in May 2023, which bans gender-manipulation procedures for minors.

Montana The "Right to Abortion Initiative" (CI-128) would provide a state constitutional  "right to make and carry out decisions about one's own pregnancy, including the right to abortion" and allow the state to regulate abortion after fetal viability.

Nebraska The "Prohibit Abortions After the First Trimester Amendment" (Initiative 434) would amend the state constitution to prohibit abortions after the first trimester unless necessary to protect the health of the mother or the pregnancy is a result of rape or incest.

The "Right to Abortion Initiative" (Initiative 439) would establish in the state constitution a right to abortion until fetal viability.

New York The "Equal Protection of Law Amendment" (Proposition 1) would bar people from being denied legal rights based on "pregnancy outcomes" and "reproductive healthcare." The proposal includes a ban on discrimination based on gender identity, elevating sexual orientation and gender identity to protected class status.

Nevada The "Right to Abortion Initiative" (Question 6) would establish a constitutional right to an abortion, including decisions about prenatal care, childbirth, postpartum care, birth control, vasectomies and tubal ligations, miscarriage and abortion care. And it would allow the state to regulate abortion after viability, with exceptions for life, physical and mental health. It would need to pass in both 2024 and 2026 to take effect.

South Dakota The "Right to Abortion Initiative" (Constitutional Amendment G) would establish a right to abortion, using a trimester framework for regulation: it would bar abortion bans in the first trimester; allow regulation only in ways "reasonably related to the physical health" of the mother in the second; and allow bans in the third but only with exceptions for the life of the mother.
