The U.S. Department of Health and Human Services has sent a letter to Gov. Greg Abbott threatening to pursue legal action if he does not rescind an order shutting down the facilities that are licensed by the state. In a disaster declaration issued on Memorial Day, Abbott instructed officials to terminate the licenses of 52 shelter and foster care facilities housing thousands of migrant children by August 30.
That move is being viewed as the latest counter-punch to the Biden administration's open-borders agenda that has flooded the U.S. Southwest, and especially Texas, with illegals.
Art Arthur of the Center for Immigration Studies says the state of Texas has the legal right to terminate the permits.
“This is one of those situations,” he tells One News Now, “where the power of the states run directly into the power of the federal government with respect to immigration."
One News Now previously reported that Gov. Abbott is vowing to use state funds to construct border barriers to help slow the record-breaking stream of illegal aliens. That story quoted Arthur, too, who advised that regulations such as environmental concerns are a major obstacle to that plan.
Regarding this latest move by Gov. Abbott, Arthur says it is Biden who has a “pretty big hurdle” to force Texas to house illegal alien minors.
