Disregarding the rights of employers and employees whose worldview is based on religious conviction and supported by biology, the Equal Employment Opportunity Commission (EEOC), a federal agency in charge of investigating complaints of employment discrimination in the workplace, has proposed a new "enforcement guidance" that designates one's failure to use someone's preferred pronouns as harassment.
According to the guidance, "sex-based harassment includes harassment on the basis of sexual orientation and gender identity, including how that identity is expressed."
"Basically, it's going to be a punishable offense to misgender someone," Jameson Taylor, director of policy and legislative affairs at AFA Action, summarizes. "People are going to be forced to affirm what is obviously a mental and spiritual deception."
Unlike many other government regulations that only apply to state or federal employees, this one applies to everyone – even customers, The Hill reports.
"The EEOC, which has authority over almost every employer in America, is pushing forward with the new policy that will destroy religious freedom rights for Christians," Taylor says.
Noting the Supreme Court's recent decision in the 303 Creative case, he calls the regulation illegal on its face.
"The Supreme Court said that you cannot force people to engage in speech or actions that are connected to questions of political and religious significance," Taylor cites.
But the Biden administration is trying to get around that with the common scheme of enforcing a regulation, which is not a law passed by Congress.
"What agencies are doing, especially under the Biden administration, is they are reinterpreting what the law says," the policy director explains.
Another example of this is Title IX. Though it establishes protections for women's sports, Biden's government agencies are twisting the term "women" to mean "transgender men."
