Shot by robbers, CBP officer pays price for 'sanctuary' policy

The robbery and shooting of an off-duty Customs and Border Patrol agent by a dangerous illegal alien is another grim example of what a “sanctuary” policy accomplishes, says a border enforcement advocate.

The unnamed CBP officer, who was shot in the face in New York City, was the victim of an armed robbery by two assailants. One of them has been identified as Miguel Francisco Nunez, a known criminal and an illegal alien from the Dominican Republic.

Ira Mehlman, of the Federation for American Immigration Reform, points out Nunez was allowed to go free by authorities in New York and Massachusetts when he should have been deported. His arrest record includes arrests for felony grand larceny, assault, criminal contempt, and armed robbery, according to the Department of Homeland Security. 

The CBP officer was on a New York street, Mehlman says, “when an illegal alien criminal, who had been put back out on the street countless times, happened to encounter him and try to rob him at gunpoint."

According to DHS, Nunez was issued a deportation order in November 2024 by an immigration court. 

However, even a criminal such as Nunez is protected from deportation if they live in New York City and the state of Massachusetts. Those liberal jurisdictions refuse to honor ICE detainers that would keep Nunez behind bars until he can be transferred into ICE custody.
